A Lasting Power of Attorney (LPA) will allow you to choose who would manage your financial and/or health affairs if you were not able to in the future. This may not be something people consider until there is a need. Often by this point, it is too late to set the LPA up as the person signing the documents must have full capacity. Therefore our advice is always to get a LPA in place sooner rather than later.
Anyone over the age of 18 can have a Lasting Power of Attorney.
We are all now living longer and sadly the likelihood of us developing illnesses such as dementia or cancer are therefore increased which makes the likelihood of family support more of a reality.
It is often assumed that if we were unable to look after our own affairs that those closest to us would simply take over and make decisions about our finances and health care, but unfortunately this would not be the case.
Financial institutions such as banks and pension companies now require sight of a Lasting Power of Attorney document before they will allow a family member, or even spouse, to manage the affairs of a connected vulnerable or incapacitated person.
Lasting Powers of Attorney are therefore crucial to save your loved ones time, expense and emotional stress in the future.
